These Terms & Conditions apply to all surf lessons and related activities provided by CV Selancar Bersama Aldo, operating under the name Surf With Aldo, in Bali and Lombok, Indonesia.
Â
Surf With Aldo exclusively provides instructed surf lessons and coaching. We do not rent surf equipment without a lesson.
Â
By booking and confirming a surf lesson with Surf With Aldo via WhatsApp or email, you acknowledge that you have read, understood and agreed to these Terms & Conditions. If a booking is made on behalf of another participant, the person making the booking is responsible for ensuring that all participants are aware of these Terms & Conditions.
1. Participation and inherent risks
Surfing is an adventure sport that involves inherent and unavoidable risks.
Â
These risks may include, but are not limited to, strong currents, waves, changing tides, shallow water, reefs, rocks, sandbanks, marine life, weather conditions, collisions with surfboards or other surfers, equipment failure, falls, physical exhaustion, drowning, injury and, in exceptional circumstances, serious injury or death.

By participating in a surf lesson, participants acknowledge and voluntarily accept the risks inherent in surfing and ocean-based activities.
​
Participation is at the participant's own risk, subject always to any rights or liabilities that cannot lawfully be excluded under applicable Indonesian law.
2. Safety instructions
Participants must follow all safety instructions given by Surf With Aldo instructors before, during and after a lesson.

Our instructors have the right to modify, pause or immediately terminate a lesson if they consider conditions unsafe or if a participant:

fails to follow safety instructions;

behaves recklessly or endangers themselves or others;
-
appears physically unable to continue safely;
-
is under the influence of alcohol or drugs; or
-
otherwise creates an unsafe situation.
Â
The instructor's decision regarding immediate water safety is final.
Â
Where a lesson is shortened or terminated because a participant fails to follow instructions, behaves unsafely or is under the influence of alcohol or drugs, no refund will be due.
3. Swimming ability
Participants must be able to swim confidently and must inform Surf With Aldo before the lesson if they have limited swimming ability or any concerns about being in open water.

Surfing takes place in a natural ocean environment. Participants are responsible for honestly assessing and communicating their swimming ability.
​
Additional safety equipment, including life jackets where appropriate, may be used for younger children.
4. Health and medical responsibility
Each participant is responsible for determining whether they are physically and mentally capable of participating safely in a surf lesson.
​
Any medical condition, injury, physical limitation, medication or other circumstance that could affect safe participation must be disclosed to Surf With Aldo before the lesson.
​
This includes, but is not limited to, pregnancy, recent surgery or injury, cardiovascular conditions, epilepsy or other conditions that may increase the risks associated with physical activity or being in the ocean.
​
Surf With Aldo does not provide medical advice. Participants who are uncertain about their ability to participate should seek advice from an appropriate medical professional before taking part.
​
Failure to disclose relevant health information may result in the participant being refused participation or the lesson being terminated for safety reasons.
5. Children and minors
Children may participate subject to the following minimum ages:
​
Bali: from 5 years old. Children may participate in an age-appropriate format, including tandem surfing where appropriate.
​
Lombok: from 6 years old.
​
Participation by anyone under 18 requires the consent of a parent or legal guardian.
​
Parents or legal guardians remain responsible for deciding whether participation is appropriate for their child and must disclose any relevant medical, developmental, swimming or other safety information before the lesson.
​
Surf With Aldo may use additional safety measures for children, including life jackets, tandem surfing or adapted instruction, depending on the child's age, ability and ocean conditions.
​
The instructor may refuse or discontinue a child's participation whenever they consider it unsafe to continue.
6. Lesson formats and instructor ratios
Surf With Aldo offers private, semi-private, group, family and children's surf lessons.
​
For safety and personal attention, Surf With Aldo operates with a maximum ratio of two participants per instructor.
​
The exact lesson format may be adapted according to participants' ages, experience, surf conditions and safety requirements.
7. Equipment included
The necessary equipment for the surf lesson is provided and includes:
​

surfboard;
-
leash;
-
rash guard; and
-
drinking water.
Â
Surf With Aldo does not provide standalone surfboard or equipment rental. Equipment is supplied solely in connection with an instructed surf lesson.

Participants must use the equipment responsibly and follow the instructor's directions regarding its use.
8. Surf locations
Surf With Aldo provides surf lessons throughout Bali and Lombok, Indonesia.
​
The exact surf location may vary depending on swell, tide, wind, weather, participant ability, experience and other safety considerations.
​
A particular surf spot cannot therefore always be guaranteed.
​
Surf With Aldo may change the agreed surf location where reasonably necessary to provide safer or more appropriate conditions for the participant.
9. Booking and confirmation
Bookings can be made via WhatsApp or email.
​
A booking becomes confirmed once Surf With Aldo has explicitly confirmed the date, approximate time and/or lesson arrangement with the customer.
​
By confirming the booking, the participant agrees to these Terms & Conditions.
10. Payment
Payment is made in cash in Indonesian Rupiah (IDR) at the start of the lesson, unless another arrangement has explicitly been agreed in advance.

No payment is normally required when making the booking.
11. Customer cancellations
We understand that travel plans can change. We therefore ask participants to treat confirmed bookings and the reserved time of our instructors with mutual respect.

A confirmed lesson may be cancelled or rescheduled free of charge up to 24 hours before the agreed lesson time.
Â
For cancellations within 24 hours, participants are asked to contact Surf With Aldo as soon as possible. Because payment normally takes place at the start of the lesson, no advance payment will normally need to be refunded.
Â
Repeated late cancellations or no-shows may result in Surf With Aldo declining future bookings.
12. Late arrival
Participants should arrive at the agreed meeting point at the agreed time.
Â
Surf With Aldo will wait for a maximum of 15 minutes.
Â
If a participant arrives late, the lesson may still end at the originally scheduled finishing time and will therefore be shorter. The full agreed lesson price remains payable.
Â
After 15 minutes without contact, the participant may be considered a no-show and Surf With Aldo is not required to provide the lesson.
13. Weather, ocean conditions and cancellation by Surf With Aldo
Ocean conditions can change quickly. Safety always takes priority over a scheduled lesson.
Â
Surf With Aldo reserves the right to postpone, relocate, reschedule or cancel a lesson due to unsafe surf or weather conditions, tides, natural events, instructor illness, force majeure or any other circumstances that make the lesson unsafe or impracticable.
Â
Where possible, an alternative time, date or surf location will be offered.
Â
If Surf With Aldo cancels a lesson before it starts, no payment is due.
Â
If payment has already been made and Surf With Aldo cancels the lesson without providing the agreed service, the relevant payment will be refunded or, with the participant's agreement, applied to a rescheduled lesson.
14. Alcohol and drugs
Participants may not take part in a surf lesson while under the influence of alcohol, recreational drugs or any other substance that may impair judgment, coordination or physical ability.

Surf With Aldo instructors may refuse participation or terminate a lesson if they reasonably believe a participant is impaired.
Â
Safety decisions made by the instructor in these circumstances are final.
15. Personal belongings
Participants remain responsible for their personal belongings at all times.
Â
To the maximum extent permitted by applicable law, Surf With Aldo is not responsible for loss, theft or damage to personal belongings, including phones, cameras, jewellery, money, clothing or other valuables brought to the beach or lesson location.
Â
Participants are advised to leave unnecessary valuables in a secure place.
16. Insurance
Surf With Aldo strongly recommends that all participants have adequate travel, medical and/or accident insurance that covers surfing and other water sports in Indonesia.
Â
Participants are responsible for checking the terms and coverage of their own insurance.
Â
Surf With Aldo does not provide personal accident, medical or travel insurance to participants.
17. Liability and assumption of risk
Participants acknowledge that even when reasonable safety precautions are taken and professional instruction is provided, the inherent risks associated with surfing and the ocean cannot be completely eliminated.
Â
By participating, each participant voluntarily assumes the ordinary and inherent risks associated with surfing and ocean-based activities.
Â
To the maximum extent permitted by applicable Indonesian law, Surf With Aldo, CV Selancar Bersama Aldo, its instructors, staff and representatives shall not be liable for injury, illness, death, loss, damage, expense or other consequences arising from:

the inherent risks of surfing and ocean activities;
-
waves, currents, tides, reefs, rocks, marine life or other natural conditions;
-
sudden or unforeseeable changes in weather or ocean conditions;
-
the acts or omissions of other surfers, participants or third parties;
-
a participant's failure to follow instructions;
-
a participant's failure to disclose relevant medical or physical information;
-
a participant's own negligent, reckless or unsafe conduct; or
-
risks that could not reasonably have been prevented by Surf With Aldo.
Nothing in these Terms & Conditions excludes, restricts or transfers any liability, right or obligation where such exclusion, restriction or transfer is prohibited by mandatory Indonesian law.
18. Third parties and natural conditions
Surf With Aldo operates in public and natural environments and does not control the conduct of other surfers, swimmers, boats, beach users or other third parties.

Surf With Aldo also cannot control natural ocean conditions.
Â
Subject to applicable law, Surf With Aldo is therefore not responsible for loss or injury caused solely by independent third parties or natural conditions outside its reasonable control.
19. Photography and video
Photos and videos may be taken during surf lessons and may be used by Surf With Aldo for its website, social media and other promotional purposes.
Â
Participants who do not wish to appear in promotional photographs or videos should inform Surf With Aldo before the lesson begins.
Â
For minors, Surf With Aldo will seek consent from a parent or legal guardian before knowingly using identifiable photographs or video footage for promotional purposes.
20. Language and communication
Surf lessons are conducted in English or Indonesian.
Â
Participants are responsible for informing the instructor if they do not understand a safety instruction or explanation.
Â
Participants should never enter the water or continue an activity when they are uncertain about an instruction. Questions or misunderstandings should be raised with the instructor immediately.
21. Force majeure
Surf With Aldo shall not be responsible for failure or delay in providing a lesson where this results from circumstances reasonably beyond its control, including but not limited to extreme weather, dangerous ocean conditions, natural disasters, government restrictions, road closures, emergencies or other force majeure events.

Where reasonably possible, Surf With Aldo will offer an alternative arrangement.
22. Severability
If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable under applicable law, that provision shall apply only to the maximum extent legally permitted.
Â
The remaining provisions will continue to apply to the extent permitted by law.
23. Governing law and disputes
These Terms & Conditions and all surf lessons provided by Surf With Aldo are governed by the laws of the Republic of Indonesia, including applicable mandatory consumer protection law. Indonesia's Consumer Protection Law No. 8 of 1999 remains in force.

In the event of a complaint or dispute, the participant and Surf With Aldo agree to first attempt to resolve the matter in good faith through direct consultation.
Â
Where a dispute cannot be resolved amicably, it shall be handled in accordance with the dispute-resolution mechanisms and competent jurisdiction available under Indonesian law.
24. Acceptance of these Terms
By confirming a booking via WhatsApp or email and/or participating in a Surf With Aldo surf lesson, the participant confirms that they have had the opportunity to read these Terms & Conditions and agrees to be bound by them.

For participants under 18, the parent or legal guardian providing consent accepts these Terms & Conditions in connection with the minor's participation.
